The 10th amendment is very important to understand your rights especially when the Federal Government is involved in your child’s education.
Our founding fathers did not claim federal authority over public education and never has one in a court of law been made. Instead in 1791, the 10th amendment gave the rights to education to the 14 states.
The federal government and the Department of Education seem to forget more and more every day that parents are recognized as having the primary responsibility for the upbringing of their children, including education. “It is States and communities, as well as public and private organizations of all kinds, that establish schools and colleges, develop curricula, and determine requirements for enrollment and graduation. The structure of education finance in America reflects this predominant State and local role.”
Since the Constitution was written the Supreme Court has made forward strides in overseeing public education such as the Civil Rights Act of 1964; yet enormous mistakes like No Child Left Behind which was a failure of epic proportions that was then revived as the Every Student Succeeds Act most recently. You have the right to Free Appropriate Public Education, the Right to Privacy (PPRA), the Right to Information and participation (FERPA), the right to be safe in school and the RIGHT NOT TO BE DISCRIMINATED AGAINST!
